1. Purpose and Scope of Application


These General Terms and Conditions of Sale (hereinafter “T&Cs”) govern all sales concluded between Halal Traders & Services (hereinafter “the Seller”), a wholesaler and distributor of food products intended for catering professionals (traditional and fast food) as well as individuals, and any natural or legal person (hereinafter “the Client”) making a purchase via the website htsclick.com.
Any order implies full, unconditional acceptance of these T&Cs, which prevail over any other document issued by the Client, unless otherwise agreed in writing and signed by the Seller.

2. Products and Availability


The products offered comply with current French legislation and applicable standards. The photographs, descriptions, and information on the website are provided for information purposes only and do not constitute a contractual commitment.
If a product becomes unavailable after the order has been placed, the Seller will inform the Client by any appropriate means. The Client may then choose either a full refund of the unavailable product or an exchange for another product of equivalent value.

3. Orders


Orders can be placed online on the website htsclick.com or by telephone.
The Seller reserves the right to refuse any order that appears abnormal, fraudulent, or in the event of a payment dispute related to a previous order.

4. Prices and Payment Terms


Prices are expressed in euros (€) and are exclusive of taxes (excl. VAT), unless otherwise stated.
Delivery costs are invoiced in addition and specified before order confirmation.
Payment is due immediately upon ordering, by credit card, bank transfer, or any other method accepted by the Seller.

When the Client chooses to pay upon delivery, the order will be treated as an online reservation without purchase obligation. Payment of the full amount is required at the time of delivery. The sale will be considered concluded in-store. In case of non-payment, the Seller reserves the right not to deliver and to reclaim the goods in full. A penalty may be charged by the Seller for orders including frozen products.

5. Delivery


Products are delivered to the address provided by the Client when placing the order.
Delivery times are given for reference only and may vary depending on product availability, order volume, and geographical location.
Risk transfer to the Client occurs upon handover of the products to the carrier.

6. Receipt and Claims


The Client must check the condition of the goods upon delivery and record any written reservations on the delivery note, confirmed by registered letter to the carrier within three (3) business days, in accordance with Article L.133-3 of the French Commercial Code.
Any claim regarding product conformity must be submitted in writing to the Seller within forty-eight (48) hours of delivery.

7. Right of Withdrawal and Returns


In accordance with Articles L.221-18 et seq. of the French Consumer Code, individual Clients have a period of fourteen (14) days from receipt of the order to exercise their right of withdrawal.
However, pursuant to Article L.221-28 of the French Consumer Code, this right does not apply to food products likely to deteriorate or expire rapidly (fresh, frozen, bulk products, etc.), nor to products unsealed after delivery for health or hygiene reasons. Frozen products, which by nature cannot be returned or are likely to deteriorate quickly, cannot be subject to withdrawal, return, exchange, or refund.

For other products not covered by this exclusion, returns will only be accepted with prior written agreement from the Seller, provided the products are complete, intact, in their original packaging, and accompanied by the corresponding invoice. Return costs are borne by the Client.

From the date of your withdrawal request, we may arrange with you for a courier to collect the product(s) concerned.

The products must be returned at your expense, using a method that guarantees adequate protection and conservation, equivalent to the initial delivery conditions.

Provided the products are returned within 14 days of exercising the right of withdrawal, in their original packaging, complete, in perfect condition, and accompanied by the purchase invoice, you will be refunded within 14 days, either:

  • by a credit note applied to your next order or purchase, or
  • by bank transfer for the value of the returned products and the delivery costs.

8. Legal Warranty


The Seller is liable for product conformity defects and hidden defects under Articles L.217-4 et seq. of the French Consumer Code and Articles 1641 et seq. of the French Civil Code.

9. Liability


The Seller cannot be held liable for any damage resulting from improper use of the products or failure to comply with storage conditions.
Under no circumstances shall the Seller be held liable for indirect or immaterial losses incurred by the Client, such as loss of profit, business interruption, or commercial damage.

10. Force Majeure


The Seller shall not be held liable for the total or partial non-performance of its obligations in the event of a force majeure event, as defined by Article 1218 of the French Civil Code and French case law.

11. Intellectual Property


All elements of the website htsclick.com (texts, images, logos, graphic charter, etc.) are protected by intellectual property rights and remain the exclusive property of the Seller.

13. Governing Law and Jurisdiction


These T&Cs are governed by French law.
Any dispute relating to their interpretation and/or execution shall fall under the exclusive jurisdiction of the courts in the district of the Seller’s registered office, unless mandatory legal provisions provide otherwise.
